NYC Lead Paint Rules: Key Updates for 2025

New York City has updated its lead-based paint laws, and property owners need to take action before the August 9, 2025 deadline. All rental units and common areas in buildings built before 1960, or between 1960 and 1978 if known to have lead paint, must be tested using an XRF (X-ray fluorescence) device by a certified inspector. Results must be documented and kept on file for 10 years.

If a child under age 6 lives in the unit, any peeling or damaged paint is considered a lead hazard and must be addressed immediately using lead-safe work practices by certified contractors. When a unit turns over, owners are required to repair peeling paint, address window and door friction surfaces, ensure floors and sills are smooth and cleanable, and certify that the work has been done. Tenants must also receive a lead hazard information pamphlet.

Starting in September 2024, owners must distribute annual lead notices to tenants. If no response is received, an investigation is required to determine if a young child lives in the unit. Owners who test negative for lead or have fully abated it can apply for an exemption through the city’s Lead Exemption Online Portal.

Failure to comply may result in violations and fines. These changes are part of Local Laws 31, 111, 122, and related legislation aimed at reducing lead exposure in NYC housing.
