Choose or Lose: The Lawyer's Role in Selecting a Title Insurer
Instructor: Russell Giorno

This lecture poses the question: What should the real estate practitioner do when a referral is conditioned upon the attorney placing the title insurance order with an agency affiliated with or controlled by the real estate broker’s firm?

The first section will discuss New York State Insurance law and the fact that any person or entity who accepts or receives a commission or rebate shall be subject to a penalty equal to the greater of one thousand dollars or five times the amount thereof.

The next section will go over the Rules of Professional Conduct. We will go over general rules of conduct and how they relate to selecting a title company based on the company’s strengths, both service related and based on financial strength.

This course will also go over Ethics Opinions and Disciplinary proceedings. We will answer the question: May an attorney accept repeated referrals from a real estate broker? An attorney must be especially wary of any influences which may serve to dilute his professional loyalty or independence.

Lastly we will speak about the Real Estate Settlement Procedures Act and the prohibition against kickback and unearned fees. We will also touch on “Joint Ventures”. We will go over the list that HUD has provided in order to determine if an affiliated business arrangement is compliant.



Zoning Principles and Strategies

This course focuses on the fundamentals of zoning and land use, exploring the foundations of zoning, the powers and duties of the planning board and the zoning board of appeals, and the role of enforcement officials in the zoning process. Emphasis will be placed on the criteria associated with the issuance of use and area variances and interpretations of the zoning ordinance. Practical advice will be offered in representing applicants before municipal boards.


Navigating New York City Websites

This course is an overview of available New York City and New York State websites for the New York City Real Estate Practitioner. ACRIS website demonstration will show online documents for New York City properties. Building Department section will highlight certificate of occupancy, Environmental Control Board Liens and all Building Department Violations. New York City Department of Finance website demonstration will go over taxes, water bills, assessments and valuation. The housing, preservation and development section of the course will highlight building registration (Multiple Dwelling Registration), violations and emergency repairs.
